Anyone out there help me out with a decal question. I've taken a couple photos and had them professionally turned into usable copies of garden tractor equip. I know the Ellinwood co. is out of business, does Bolen still use this logo? I'm fairly knowledgable about copyright issues and don't want to upset no one (too much any ways). Here's some photos of shirts my buddy has made up. What do you think?

You should be fine the bolens logo is over 50 years old.

Nice shirts.. I wouldn't worry about copyright to much unless you try to mass produce them for a profit.

often you have more then one copyright owner, f.e. the company and the designer of the logo.

The Bolens logo you show was used on attachments in the late 1940's up through at least the mid-1950's. Various people are reproducing that design as decals for restoring those same attachments. I have not yet heard of any of them getting in trouble for reproducing that design or others from the same era. If you want to be absolutely sure, you could always ask the legal department at MTD. I believe that they bought both the hard assets and the Intellectual Property rights to Bolens from Gardenway, who purchased the same when Bolens was being liquidated.

I still think you are ok though.

 

Since FMC owned Bolens back then I wonder if MTD really has a say in anything named (Bolens by FMC) anyway?
