Be careful when consuming alcohol and driving your garden tractor.  You may end up like this guy.

That's sad.  The guy just wanted some seat time.  Should have stayed in his own yard...better yet, stayed in the house.

Staying in his yard wouldnt save him either. I know this is extreme but... You can get a dui in your house if you are operating a "motor vehicle".
So lets say you and the buddies are riding a moped in your basement and drinking and the neighbor calls the cops because of the "noise" they can, and will arrest someone for dui inside your house.

Yep, read in the paper here a few years back about a guy mowing his lawn on a hot summer day, comfortably on his gt with a beer in one hand, 'til a cop came along and issued a summons for operating with an open container....

On a public roadway is one thing but in your own yard minding your own business makes for one asinine officer.

That happens more often than you might think. In Iowa Operating a Motor Vehicle under the influence does not specify a type of vehicle(motor powered).

It applies to any motor vehicle including Tractors and Boats as well.

I knew a guy who lost his drivers license. He Mowed city parks and Cemetary in a town about 14 miles away from his home.

This was back when the John Deere 400 was new, and he got a ticket for operating that while intoxicated about 7 miles south of town on his way back from Monroe.

Even if your not driving anything you can still get a DUI. A buddy of mine (which was drinking) got into an arguement with his girlfriend at the time, he left to go to his shop and she called the sheriff. An hour and a half later (fast responce time :D ) the sheriff showed up and arrested him for DUI even though he was just sitting at the shop drinking. He went to court to fight it and lost, which seems like a load of crap to me. 2 years later he's still trying to get his class A back.

 

The cops around here can give you a DUI if your working on your car in your garage with the engine tore apart as long as the keys are in the ignition. Pretty sad
